PROCESS QUESTIONS
BEFORE STARTING THE PROCESS
If you are already in the United States, you can apply as long as you make sure that you will maintain a legal status during the time that the EB3 program takes. If for some reason your legal status cannot be extended and you have to return to your country, you can continue with the EB3 process to be finalized outside the United States as consular processing.
If you are with a J1 Visa you can apply for an EB3, you must make sure to keep the J1 visa valid during the process and in case it is not possible you can finish the process in your country of origin or a country outside the United States as process consult.
People who apply for Asylum can apply to an EB3 process as long as there has not yet been a definition on asylum and they have not gone to Trial.
We recommend that people do not leave the United States when starting phase 2 of the EB3 process, this is once the I-140 has been filed. The reasons for this recommendation is to avoid risks when re-entering the United States with a tourist visa when an intention to immigrate to the United States has already been filed.
To work in the United States you must have an explicit authorization to do so, working illegally and receiving payment for carrying out said work may constitute an inadmissibility that you must keep in mind before making the decision to apply to an EB3 process.

UPON ARRIVING IN THE UNITED STATES WITH AN EB3 VISA
We facilitate your location process by providing you with prior information, developing informative webinars, and putting you in contact with external people and companies that can help you throughout the process of searching for housing, schools, transportation, banks, and knowing key information for living in the United States.
When you are in the United States and subject to fulfilling the work commitment you have with your sponsor, you may travel outside of the United States as long as the duration outside does not exceed 180 days.
If you reach an agreement with your Sponsor and the work allows it, it is possible that you can develop other types of work activities.
The first entry into the United States once the EB3 is approved must be with the applicant and the entire family nucleus linked to the process, this in order to file the papers before immigration and to begin the process of generating the Green Card and the SSN (Social Security number).
The Sponsor can make a decision to revoke your visa, it is very important to comply with the moral commitment to work for 1 year or more, depending on the commitment with your Sponsor and avoid future situations that could jeopardize your resident status or even apply to citizenship later.
The pet travel process is completely external to MCC USA and is not part of the EB3 process.
